Reason Action Is Urgently Needed: The House of Representatives is scheduled to vote on H.R. 3962 tomorrow, Saturday, November 7, 2009. While NAIFA continues to support reform and is pleased that specific language, originally offered by Rep. Melacon (D-LA), authorizing agent participation is included,  H.R. 3962 has reached the tipping point where we must oppose the current version. House Republicans will be allowed to offer one floor amendment. The House bill will have no opportunity for other amendments. There are a number of issues that need further review including but not limited to:

  • COBRA Extension - page 70
  • Fair Marketing - page 119
  • HCC Commissioner Non-Exchange Authority - page 127
  • FTC Insurance Studies - page 149
  • McCarran-Ferguson Act - page 150
  • Exchange Open by Year 3 - page 156
  • Commissioner Authority to Deny Premiums & Increases - page 172
  • Commissioner to Set Auto-Enroll Process - page 185
  • Exchange Outreach & Enrollment - page 188
  • Interstate Compacts - page 202
  • Cooperatives - page 206
  • Public Option - page 211
  • Affordability Credits - page 225
  • Shared Responsibility - page 296
  • Employer Responsibilities - page 268 & 308
  • Small Biz Tax Credits - page 317
  • HSA Rx Med & Insulin Only - page 324
  • FSA Contribution Limits - page 325
  • Limited Exchange in Cafeteria Plans - page 330
  • Medicare Advantage - page 520
  • New government LTC program (CLASS) - page 1562

The House bill as currently drafted fails to meet NAIFA's reform goals of providing affordable coverage to all Americans without resorting to new government programs.
